Allegations of Fraudulent Inducement and Copyright Infringement
Former U.S. Representative George Santos has filed a lawsuit against late-night host Jimmy Kimmel, ABC, and Walt Disney Co., claiming that Kimmel deceived him into creating videos on the Cameo app that were later used to mock him on the show. The lawsuit, filed in a New York district court, accuses Kimmel of misrepresentation and fraudulent inducement.
Santos’ Claims and Lawsuit Details
Santos, who was expelled from the House of Representatives due to fraud and theft charges, alleges that Kimmel misled him into making personalized videos that were later used to ridicule his personality. The lawsuit cites copyright infringement, fraudulent inducement, breach of contract, and unjust enrichment as the basis for legal action.
Deceptive Requests and Show Segments
According to the complaint, Kimmel submitted fake requests to Santos through the Cameo app, resulting in videos that were aired on Kimmel’s show. One segment, titled “Will Santos Say It?”, featured clips where Santos unknowingly participated in humorous scenarios, such as congratulating a fake winner of a beef-eating contest.
Legal Action and Damages Sought
Robert Fantone, an attorney for Santos, emphasized that while Kimmel’s actions may have been comedic, they constituted a violation of copyright law. Santos is seeking $750,000 in statutory damages for the videos played on the show and social media platforms. Additionally, Santos is requesting further damages to be determined during trial.
Political and Legal Background
Santos, who faces multiple criminal charges related to fraud and misuse of funds, pleaded not guilty to revised charges in October. Democrat Tom Suozzi recently won a special election to fill Santos’ former seat in the House of Representatives.
