In explaining the shift towards court packing, Fallon cited advice from left-wing activist Elie Mystal, who has called for the addition of 10 new Supreme Court Justices. Demand Justice has met with multiple Democratic senators to discuss legislation proposing the addition of 4 seats to the Supreme Court. Several top aides in the Biden administration, including former White House press secretary Jen Psaki and judicial nominations point person Paige Herwig, have connections to Demand Justice. Christopher Kang, another co-founder of the group, served in the Obama-Biden administration.

During his time with Demand Justice, Fallon had close access to the Democracy Alliance, a group of wealthy Democrat donors.
